Terms of Service

These terms govern your use of the PelicanNET website, the PelicanNET relay service, and the PelicanNET client software. By creating an account or using the service, you agree to them.

1 · Who we are

PelicanNET is operated by Gary Bissett ("PelicanNET", "we", "us"), based in Australia. You can reach us at [email protected].

2 · The service

PelicanNET is a structured voice-communications relay for online gaming organisations. It routes live voice between Discord channels via relay infrastructure we operate, controlled through client software we supply (the Comms Deck app, Stream Deck plugin and profiles, and seat kits). The service is currently offered as a pilot/early-access product and its features may change.

5 · Software licence

Client components are licensed, not sold. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the client software solely with the PelicanNET service. Each seat kit ships with an end-user licence (LICENSE.txt); if there is any conflict, that licence governs the client components. All rights not expressly granted are reserved.

6 · Intellectual property

"PelicanNET", the PelicanNET emblem, and all software, documentation, and artwork in the service are the property of Gary Bissett and are protected by copyright and trademark law. PelicanNET is an independent communications tool. It is not endorsed by or affiliated with Cloud Imperium Games or Roberts Space Industries; "Star Citizen" and related marks are the property of their respective owners. Discord is a trademark of Discord Inc.

7 · Availability

We aim to keep the service reliable, but we do not guarantee uninterrupted availability. The service depends on third-party platforms (including Discord and our hosting providers) that are outside our control. We may modify, suspend, or discontinue features, particularly during the pilot phase, and will give reasonable notice of material changes where practicable.

8 · Fees

Pilot access is currently free. If and when paid plans are introduced, pricing and billing terms will be published on the pricing page and will apply only after you choose a paid plan.

9 · Termination

You may stop using the service and ask us to close your account at any time. We may suspend or terminate access for breach of these terms, for security reasons, or if the service is discontinued. On termination your licence to use the client software ends and you must stop using and delete your seat kits and keys.

10 · Disclaimers and liability

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, and we are not liable for indirect or consequential loss, loss of data, or loss arising from third-party platforms. Our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim arose (or AUD $50 if you have paid nothing).

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where liability can be limited, it is limited to re-supplying the service or paying the cost of re-supply.

11 · Changes to these terms

We may update these terms from time to time. We will post the updated version on this page with a new "last updated" date, and for material changes we will make reasonable efforts to notify account holders. Continued use of the service after a change takes effect constitutes acceptance.

12 · Governing law

These terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the Australian courts.
